भारतीय संविधान अनुच्छेद 2 – नए राज्यों का प्रवेश या स्थापना

संविधान का अनुच्छेद 2 संसद को दो शक्ति प्रदान करता है –
(1) राज्यों को भारत के संघ में मिलाने की शक्ति, यह पहले से मौजूद राज्यों के लिए है।
(2) नए राज्यों की स्थापना करने की शक्ति, यह शक्ति जो पहले राज्य नहीं थे उनके लिए।

★ राज्य का प्रवेश या स्थापना के लिए संसद का सामान्य बहुमत से किया जा सकता है। इसके लिए विशेष बहुमत की आवश्यकता नहीं है। इसलिए अनुच्छेद 2 के अंतर्गत संविधान में किए गए संशोधन अनुच्छेद 368 के अंतर्गत नहीं माना जाएगा।
◆ इस अनुच्छेद के संशोधन के लिए संसद का संयुक्त अधिवेशन बुलाया जा सकता है।
★ अनुच्छेद 2 में संशोधन करने पर संविधान की अनुसूची 1 और अनुसूची 4 में बदलाव होगा।

अनुच्छेद 2 (क) – सिक्किम का संघ के साथ सहयुक्त किया जाना – संविधान (36 वां संशोधन) अधिनियम, 1975 की धारा 5 द्वारा (24-4-1975 से) निरसित।
★ 35वां संविधान संशोधन विधेयकके द्वारा सिक्किम को भारत का ‘सहयुक्त राज्य’ बनाया। जिसमे अनुच्छेद 2क और अनुसूची 10 मे सुधार किया गया।

Constitution Of India Article 2 – Accession or Establishment of New States

Article 2 of the Constitution gives two powers to the Parliament –
(1) Power to amalgamate states into the Union of India, it is for pre-existing states.
(2) Power to establish new states, this power for those who were not earlier states.

★ The entry or establishment of a state can be done by a simple majority of the Parliament. It does not require a special majority. Therefore, amendments made to the Constitution under Article 2 will not be considered under Article 368.
◆ A joint session of Parliament can be called to amend this article.
★ Amendment in Article 2 will change Schedule 1 and Schedule 4 of the Constitution.

Article 2 (a) – Sikkim to be associated with the Union – Repealed from 24-4-1975 by section 5 of the 36th Constitutional Amendment Act 1975.
★ By the 35th Constitutional Amendment Bill, Sikkim was made ‘Associated State’ of India. In which Article 2A and Schedule 10 were amended.
